Terms of Service
These Terms govern the use of Dearpage, a platform to read, write, publish and follow stories, with diary features, subscriptions, translation, audio and export to Kindle. By creating an account or using Dearpage, you agree to these Terms and to the Privacy Policy.
1. Who we are
Dearpage is operated by Pedro Henrique Iamondi (MEI, sole proprietor), registered under Brazilian tax ID (CNPJ) 33.535.787/0001-45, with address at Rua 22 Be 28, Estádio, Rio Claro/SP, Brazil, ZIP 13501-388. Contact: contact@dearpage.app, and privacy@dearpage.app for privacy matters.
2. Requirements and sign-up
- You can create an account from 13 years old. People aged 13 to 17 need a guardian's authorisation, which the guardian confirms through a link sent to the e-mail given at sign-up. We do not create accounts for children under 13.
- Until a guardian authorises the account, it can browse but cannot buy, publish or interact.
- Purchases and subscriptions made by people under 18 require the guardian's authorisation, and the guardian may follow them.
- The information you provide must be true and up to date. You are responsible for keeping your password secure and for everything that happens in your account.
- You may use Dearpage with a display name that differs from your legal name, including anonymously, as long as you follow these Terms.
- We may suspend or close accounts that breach these Terms, are used for fraud, or pose a risk to others.
3. Dearpage School
Dearpage School is a feature contracted by schools. In that context the school manages classes, invitations and students, is responsible for the lawfulness of processing students' data, and for obtaining parental consent where it is required. Students use the platform under the school's rules and these Terms. The relationship between the school and Dearpage is governed by the contract signed with the school and by the Data Processing Agreement.
4. What Dearpage offers
- Reading of books, chapters and texts published by authors.
- Publishing of texts and books, with chapter management and serial release.
- A personal diary, private by default.
- Shelves, reading progress, comments, likes and interactions between profiles.
- AI-assisted features: translation, synopses, covers, voice transcription and content checks. Results are automatic and may contain errors.
- Export of books to Kindle, under a plan or with credits, for personal use.
We may change, add or remove features. When a change materially affects what you have purchased, we will give reasonable advance notice.
5. Your content
- You keep the rights in the content you publish.
- By publishing, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, distribute within the platform, adapt for reading formats and process the content with the service's tools, including automatic translation and checks. The licence lasts while the content is published and ends when you remove it, except for backups and records the law requires us to keep.
- You confirm that you have the rights needed for what you publish and that it does not infringe third-party rights.
It is forbidden to publish or send content that:
- is unlawful or encourages crime or violence;
- contains hate speech, harassment, threats or discrimination;
- involves sexual content with minors, or non-consensual sexual content, in any form;
- infringes copyright, trademarks or the privacy of others, or is plagiarism;
- contains spam, scams, malware or misleading links;
- impersonates another person or institution.
6. Adult content and classification
Content classified for adults is shown only to verified users aged 18 or over. Texts with explicit sexual content must be published in those categories, with the correct classification. Paid books may not contain chapters classified for adults. Content that is wrongly classified may be reclassified or removed.
7. Public-domain works and translation
- Public-domain works on Dearpage come from public collections and can be read for free.
- Translations made by artificial intelligence are automatic productions. Whoever requests a translation should review it before publishing and is responsible for publishing the result. We check that the translation is actually in another language, but we do not guarantee literary quality.
8. Moderation and removal
- We may remove content, hide publications, limit features or suspend accounts that breach these Terms, whether found by automatic checks, reports or human review.
- When this happens, we will tell you the reason as far as possible, and you may contest the decision through support channels.
- Copyright infringement notices can be sent to contact@dearpage.app with: identification of the content, identification of the protected work, the sender's contact details, and a statement of good faith. On receiving a valid notice, we will remove the content and inform its author.
9. Plans, subscriptions and payments
- Dearpage offers free and paid plans for readers, diary, creators and schools. Prices, billing periods and features of each plan are shown on the plans page and at the time of purchase.
- Payments are processed by Stripe. Subscriptions renew automatically until you cancel.
- You can cancel at any time. Cancellation takes effect at the end of the period already paid; there is no pro-rata refund unless the law requires one.
- If a payment fails, there is a 5-day grace period to fix it. After that, access to paid features may be suspended.
- We may change prices with advance notice. The change applies from the next billing cycle.
10. Credits, quotas and one-off purchases
- Some features, such as export to Kindle, audio and translations, are limited by quotas or credits. Quotas renew in each plan cycle.
- Credits and quotas cannot be converted into money or transferred between accounts and, except for a proven failure of the service, are not refundable.
- One-off purchases of books, chapters or tips are payments for digital content.
11. Right of withdrawal and refunds
- For purchases made over the internet, you may withdraw within 7 days of the purchase and receive a full refund, under the Brazilian Consumer Protection Code (CDC, art. 49). This applies to the first purchase and to plan subscriptions.
- After that period, refunds are assessed case by case, especially where the service failed, a charge was wrong or a charge was duplicated.
- Card chargebacks follow the rules of the card network and issuer.
12. Payouts to creators
- When a creator receives amounts from sales, subscriptions or tips, Dearpage keeps the commission set in the plan or in the conditions in force at the time of the sale.
- Payouts are made through Stripe, after security and payment-verification periods. We may withhold payouts when fraud, a refund or a dispute is suspected.
- Taxes on the creator's income are the creator's responsibility, who must keep their tax details up to date.
13. Export to Kindle
Exported files are for the personal use of the account holder, sent to the Kindle address provided. You may not redistribute, sell or publish exported files.
14. Prohibited conduct
Among other things, it is prohibited to:
- use bots, scraping or automated collection, except through authorised interfaces;
- try to access other people's accounts, systems or data;
- get around quota limits, age checks or security systems;
- decompile, copy or exploit the platform beyond what the law allows;
- send mass messages or use the platform for spam.
15. Ownership of Dearpage
The brand, layout, code and other creations of the platform belong to Dearpage or its licensors. Using the platform does not transfer any of these rights to you.
16. Closing your account
- You may close your account at any time from the app, when that feature is available, or by contacting support.
- We may close an account for serious or repeated breaches of these Terms. Where possible, we will tell you first.
- After closure, data processing follows the Privacy Policy.
17. Disclaimers and limitation of liability
- Dearpage is provided "as is", with reasonable efforts to keep the service available and secure. We do not guarantee uninterrupted, error-free operation.
- We are not responsible for content published by third parties, for AI-generated results, or for indirect losses.
- Our total liability is limited to the amount you paid in the last 12 months, unless the law provides otherwise, especially in consumer relations.
18. Changes to these Terms
We may update these Terms. For material changes, we will give reasonable advance notice in the app or by e-mail. If you do not agree with a change, you may close your account before it takes effect.
19. Governing law and venue
These Terms are governed by Brazilian law. The courts of the judicial district of Rio Claro/SP are chosen to settle disputes, without prejudice to the consumer's right to choose the court of their domicile, as the law allows.
If the translated versions differ, the Portuguese version prevails.
